You’re right. Divorce isn’t fair.

It’s one of the things I hear most often when talking to clients about their situation. “It’s so unfair.”

A common narrative around divorce suggests that it’s a “split down the middle” process, but the reality is rarely so straightforward. Different aspects of divorce—emotional, financial, and certainly legal—are rarely experienced equally by both parties.

Question: My ex took the dogs when we separated but now refuses to let me share time with them. What can I do? Answer: Unfortunately, despite the fact that they feel like family members, dogs are considered personal property in Colorado and many other states, just like furniture or other household items. This means that they are treated like anything else you own together, and will be part of your settlement. Ideally, you and your spouse can come to an agreement on how to share time with your pets. Options include having them travel with the kids per your parenting schedule, or even having designated weekends or vacation time. If you aren’t able to come to an arrangement yourself, you may have make the topic part of mediation or even have the court intervene. Have you asked your ex if there is any schedule that they would be comfortable with? It may at least be a starting point for discussion. If that doesn’t work hopefully when they realize what it will cost – financially and emotionally – to litigate the issue, they’ll reconsider.
